Terms of Carriage

Conditions of Contract governing all shipments tendered to Sprint Xpress. Please read carefully.

Important: By tendering your shipment to Sprint Xpress, you agree to be bound by all terms and conditions contained in this document, whether or not you have read them.

Definition

On this Consignment Note, "we", "our", and "us" refer to SPRINT XPRESS, its subsidiaries, branches, associated companies, divisions, and appointed agents. "You" and "your" refer to the shipper. "Packages" means any containers or envelopes submitted by you and accepted by us for carriage. "Shipment" means all packages submitted under a single Consignment Note.

Agreement to Terms

By tendering your Shipment, you agree to all terms contained in this Consignment Note — regardless of whether you sign the front — for yourself or as agent for any other person having an interest in the shipment. These conditions supersede any previous agreement between the parties.

Your Obligations

You guarantee each item is accurately stated and acceptable for delivery. You must ensure each package is properly marked, addressed, and packed for safe transportation. You are responsible for all government penalties, taxes, legal charges, and any costs incurred in returning or warehousing your shipment due to improper documentation or prohibited items.

Air Carriage Notice

If your Shipment involves a final destination in a country other than the country of departure, the Warsaw Convention (including all amendments) may apply. We are not an air carrier but act as your forwarding agent, consigning your shipment with a particular airline for onward carriage. We reserve the right to carry the Shipment by any routes we deem appropriate.

Road Transport Notice

Shipments transported partly or solely by road are subject to the terms and conditions of the Convention on the Contract for International Carriage of Goods by Road (CMR) where applicable.

Limitation of Liability

Our maximum liability is limited to US$100 per shipment or US$9.07 per pound (US$20.00 per kilogram) — whichever is greater — unless you declare a higher value and pay the additional charge. Contact us before tendering if you require higher declared value coverage.

Declared Value Limits

We will not be liable for weather conditions, mechanical delays, acts of public enemies, war, strikes, civil commotions, or acts of public authorities with actual or apparent authority. The highest declared value we allow depends on the contents and destination.

Liabilities Not Assured

We will not be liable for any direct, incidental, special, or consequential damages — including loss of income or profits — in excess of the declared value or US$100 per shipment, whether or not we knew such damages might be incurred. We are also not liable for incorrect declaration, improper packing, or violation of any agreement terms.

No Warranties

We make no warranties, express or implied, regarding the services provided under this agreement beyond what is explicitly stated in these Conditions of Contract.

Claims for Loss, Damage or Delay

All claims must be submitted in writing within 28 days of delivery (or expected delivery). Claims must be resolved within 90 days of notification. For damage claims, the original contents and packing must be available for our inspection.

Responsibility for Payment

You are always primarily responsible for all charges related to your shipment. We undertake, subject to payment per our notified rates, to carry your shipment between agreed destinations.

Export Control

By authorizing us to act as your forwarding agent, you certify that all documentation and information relating to exportation are true and correct. You accept civil and criminal liability for violation of export laws of India or any other applicable country.

Letter of Instruction

If required documents are incomplete or improper, you instruct us to complete, correct, or replace them at your expense — where permitted by law. We are not obligated to do so and are not liable for our good-faith actions under this provision.

Items Not Acceptable for Carriage

The following items are NOT accepted for carriage:

  • Dangerous, hazardous, combustible or explosive materials of any kind
  • Gold and silver — paper or coin — of any nationality
  • Negotiable securities, stocks, bonds, bearer certificates
  • Uncancelled postage or revenue stamps
  • Blank or endorsed-in-blank cashier's cheques or money orders
  • Antiques, artwork, pictures and irreplaceable items
  • Livestock, live animals or live plants
  • Human remains or ashes
  • Any items that infringe applicable laws or regulations
  • Controlled substances, narcotics or illegal drugs

Mandatory Law

Insofar as any provision in this Consignment Note may be contrary to any applicable international convention or mandatory law, such provision shall prevail to the extent required. The first carrier of any shipment is SPRINT XPRESS.
